    PETRO-POINTS CAA Joint Membership Contest

    RULES AND REGULATIONS


    1. HOW TO PARTICIPATE

    No purchase necessary

    1.1 Sponsor:  The sponsor of this contest is Petro-Canada (the “Contest Sponsor”).

    1.2 Eligibility: The Petro-Canada CAA Membership Olympic Contest (the “Contest”) is open to residents of Canada who are CAA members in the CAA South Central (“CAA SCO”), CAA Niagara (“CAA NIA”) or CAA North & East Ontario clubs (“CAA NE”) only (collectively know as “CAA Clubs”) in good standing (these specific CAA members referred to as “Member” or “Members”), except for officers, directors, employees, and retirees of the Contest Sponsor and CAA Clubs, and their respective affiliates, franchisees, agents, associates, dealers, representatives, advertising and promotional agencies, and members of the immediate family of those officers, directors, employees or retirees, or any person with whom they are domiciled.

    1.3 Contest Period:  Starting at 12:00 a.m., Mountain Time, on May 1, 2009 and ending at 11:59 p.m., Mountain Time, on September 7th, 2009 (“Contest Period”), all Members who enroll or have enrolled in the Petro-Points program to become a Petro-Points member (once enrolled in the Petro-Points program the Member will be referred to as a “Joint Member”) will receive one (1) entry into the Contest.  To become a Joint Member, the Member must enroll to become a Petro-Points member by signing up on the Petro-Canada website or by calling the Petro-Canada call centre in Canada prior to or during the Contest Period.   Limit of one (1) entry per Member.

    1.4. Awarding of Prizes: Subject to these Rules and Regulations, the Prizes will be awarded to the person whose name and address appears on the Petro-Point Membership database as a Joint Member.

    1.5. By entering the Contest, each entrant consents, to  the extent permitted by law, to the use of his/her name, image, voice, likeness, place of  residence and/or photographs (collectively, “Personal Information”) without compensation in  any publicity or advertising carried out in any medium worldwide by the Contest Sponsor , CAA Clubs, the Vancouver Organising Committee for the 2010 Olympic and Paralympic  Winter games (VANOC)  and/or their respective advertising or promotional agencies, without  limitation or further notification or compensation.

    1.6. Collection of Personal Information: The Contest Sponsor is collecting Personal Information from and about entrants for the sole purpose of administering the Contest and, unless otherwise provided for by these Rules and Regulations, information collected from an entrant is subject to the Contest Sponsor’s Privacy Policy (available through www.petro-canada.ca).

    2. PRIZES

    2.1 Grand Prize:  There will be one (1) Grand Prize awarded by a random computer-generated draw (See Rules 2.4 and 2.5), such Prize to be awarded as a Petro-Canada Dream Olympic Experience package for two (2) adult persons at the Vancouver 2010 Olympic Winter Games in British Columbia, Canada (the “Games”). The approximate retail value of the Grand Prize is twenty-three thousand Canadian dollars ($23,000).

    1) The Grand Prize consists of a four (4) day/three (3) night, Petro-Canada Dream Olympic Experience package for two (2) adults at the Games during the period of February 15, 2010 arrival until February 18th, 2010 departure..  The Grand Prize package will be organized and managed by the professional event staff at Jet Set Sports.  Details on specific hotels, event tickets and other Grand Prize package facts will be posted (as they become available) on the Petro-Canada website which can be accessed through www.petro-canada.ca/games.
    2) The Grand Prize also includes: 
    a. A sum of three thousand Canadian dollars ($3,000) that can be used by the Grand Prize winner to pay for transportation into and out of Vancouver for the scheduled Dream Olympic Experience package dates and times.  The Grand Prize winner is responsible for arranging his/her own transportation and that of his/her guest (sometimes collectively, the “Grand Prize Participants”) into and out of Vancouver.  It is strongly recommended that the Grand Prize Participants book their in-bound and out-bound transportation as soon as scheduled dates and times for the Dream Olympic Experience package are known, due to expected high travel demand throughout the duration of the Games.  If travel expenses are less than three thousand dollars ($3,000) for the Grand Prize Participants, the Grand Prize winner may keep any remainder.  If travel expenses exceed three thousand dollars ($3,000) for the Prize Participants, the excess costs will have to be covered by the Grand Prize winner. In no event will the Contest Sponsor be responsible for these excess costs;
    b. All ground transportation within Vancouver and to and from various scheduled events and activities.  As per the Dream Olympic Experience package schedule, from the moment the Grand Prize Participants arrive in Vancouver, to the moment they depart, the Prize Participants will be escorted in fully-accredited luxurious motor coaches and vehicles (to and from Prize-included scheduled events and activities).  All Jet Set Sports vehicles will be accredited with special passes for access to all special dedicated Olympic traffic lanes and superior parking at all Games venues.  Ground transportation also includes Vancouver International Airport transfers.  Grand Prize Participants will be greeted at the airport by Jet Set Sports hosts who will escort them to the vehicle that will transfer them to/from the hotel on arrival/departure days;
    c. Accommodation is provided in the form of one (1) room on a double-occupancy basis.  Rooms are secured at one of the finest properties in Vancouver, ensuring the comfort and convenience of every guest.  Accommodations will be located with easy access to Games venues, shopping, restaurants and tourist sites.  All rooms feature modern amenities, providing a great home away from home during the Games;
    d. The Grand Prize Participants will receive event tickets to three (3) events during their Dream Olympic Experience package.  Seating will be in the preferred sponsor designated seating area.  Specific events will vary depending on scheduled dates and times to be determined by the Sponsor at its sole discretion (some restrictions apply); and
    e. Food, beverages and entertainment will be provided as part of the Grand Prize package scheduled events and activities.  Dinners will be at a variety of excellent local restaurants with world-class dining and a myriad of entertainment and social options.  There will also be a designated hospitality area in the hotel where food and drinks will be available.
    Exclusions:
    • Pocket money/personal expenses and travel insurance;
    • Any other activity not mentioned in the Grand Prize; and
    • Telephone and communication fees, such as long distance calls and internet use.
    Such excluded costs are at the Grand Prize winner’s own expense.
    3) The selected entrant will be contacted by Petro-Canada.  Upon receipt of his/her duly signed Declaration and Release Form by the Contest Sponsor, the Grand Prize winner will be contacted by a Jet Set Sports representative confirming his/her Grand Prize and informing him/her on how to complete his/her registration.  The Grand Prize winner must register with Jet Set Sports as per instructions provided by Jet Set Sports.  The Grand Prize package will take place on the set dates/times as specified above and by Jet Set Sports and Petro-Canada.  No changes in dates/times will be permitted.
    4) Once a registration has been completed, no changes are permitted.
    5) The Grand Prize must be accepted as awarded by the Contest Sponsor.  Except for the cash component of the Grand Prize, no cash alternatives, substitutions, divisions, or transfers of the Grand Prize will be allowed, and the Grand Prize winner shall not be entitled to convert the Grand Prize into cash. The Contest Sponsor reserves the right to substitute the Grand Prize with a prize of equal value or greater value.

    2.2  Secondary Prizes: Twenty (20) secondary prizes of One Hundred Thousand (100,000) Petro-Points (a total of 2,000,000 Petro-Points) to be awarded by random computer generated draw.  No cash alternatives or substitutions will be allowed. Each Prize will be awarded within 4 to 6 weeks of the Draw Date. 

    2.3 Odds: The odds of being randomly selected depend on the total number of entries registered in compliance with Rules 1.2 and 1.3 during the Contest Period.
       
    2.4 Grand Prize Draw: The Grand Prize draw for the one (1) Grand Prize will be by a random computer-generated draw on September 30th , 2009 at 9:00 a.m., Mountain Time, at 2489 North Sheridan Way, Mississauga, Ontario, from all eligible entries registered as Joint Petro-Point CAA members as of September 7th, 2009.  The selected entrant will be contacted by email, telephone or mail.  At least three (3) attempts to contact the selected entrant by email, phone or mail will be made within the fourteen (14) days following the Grand Prize Draw.  If the Contest Sponsor  is unable to contact the selected entrant within fourteen (14) days following the Grand Prize Draw, another entrant will be randomly selected and the initial selected entrant will be disqualified, his/her right to the Prize will be forfeited and the Contest Sponsor and CAA South Central Club shall be fully and completely released and discharged from any liability or responsibility in this regard, and that entrant will have no recourse against the Contest Sponsor, CAA SCO, CAA NIA, CAA NE or anyone else involved in the Contest.  The CAA membership account must be in good standing at the time of the Grand Prize Draw to be eligible. 

    In order to win, the selected entrant must first correctly answer, unaided, a time-limited, arithmetical, skill-testing question to be administered by telephone or email and sign and return to the Contest Sponsor a standard Declaration and Release form confirming compliance with the Contest Rules and Regulations, acceptance of a Prize, as awarded, and releasing the Contest Sponsor and CAA Clubs from all liability.  The selected entrant will have seven (7) days to return to the Contest Sponsor the Declaration and Release form upon receipt. If the selected entrant does not do so, another entrant will be randomly selected and the initial selected entrant will be disqualified, his/her right to the Prize will be forfeited, and the Contest Sponsor and CAA Clubs shall be fully and completely released and discharged from any liability or responsibility in this regard, and that entrant will have no recourse against the Contest Sponsor, CAA Clubs or anyone else involved in the Contest.  The guest accompanying the Grand Prize winner must also sign a standard Declaration and Release form.  In the event that the guest is a minor, the form must be signed by a parent or legal guardian of the guest.

    2.5 Secondary Prize Draw:  Twenty (20) secondary prizes of One Hundred Thousand (100,000) Petro-Points (a total of 2,000,000 Petro-Points) to be awarded by random computer generated draw on the date specified in column C in the table below. All registered Joint Petro-Point CAA members as of the date specified in column B in the table below will be eligible.  No cash alternatives or substitutions will be allowed. Each prize will be awarded within 4 to 6 weeks of the Draw Date.    All secondary prizes will be drawn at 9:00 a.m. Mountain time at 2489 North Sheridan Way, Mississauga, ON from all registered Joint Petro-Point CAA members as of the date specified in column B.  The CAA membership account must be in good standing at the time of the Prize Draw to be eligible.  Following completion of the applicable provisions of the Contest, the winner of a secondary prize will automatically have the Petro-Canada Points Prize added to their Petro-Points account points balance within seven (7) days, and will then be available for reward redemption, subject to the terms and conditions of the Petro-Points program.

    3. GENERAL RULES

    3.1 All Prize claims are subject to verification by the Contest Sponsor and/or its designated representatives.  Entries made with multiple addresses, under multiple identities, through the use of any device or artifice to enter multiple times or entries that are in excess of the permitted number of entries for the Contest Period are automatically void.  All Contest entries or purchase transaction receipts obtained through unauthorized sources or which are illegible, mutilated, altered, reproduced, forged or irregular in any way, are automatically void.  The Contest Sponsor will be the sole and final reference source in validating Prize claims. 

    3.2 If a dispute arises regarding the Member who submitted an entry, the entry will be deemed conclusively to be submitted by the primary Member, as identified on the Petro-Points membership database as provided at the time of entry.

    3.3 By participating, each Contest entrant and the Prize winner agree (a) to be bound by these Rules and Regulations and the decisions of the Contest Sponsor; and (b) to release, indemnify and hold harmless the Contest Sponsor and CAA Clubs, VANOC, their respective affiliates, subsidiaries, and independent contractors, and their respective directors, officers, shareholders, employees, agents and representatives, including advertising and promotion agencies, from any and all liability for claims/damages including, but not limited to, claims/damages for personal injury, including death, or for property damage with respect to or arising from acceptance, possession or use or misuse of the Prize or participation in the Contest, or for claims based on publicity rights, defamation, or intrusion of privacy,

    Each Prize winner agrees to sign a Declaration and Release Form to the effect referred to above. All decisions of the Contest Sponsor respecting the Contest will be final and binding on all entrants.

    3.4 The Contest Sponsor shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, computer equipment, software, or any other error or malfunction that render an entrant ineligible to enter the Contest or affects his/her chances of being selected to win, or for late, lost, stolen, postage due, illegible or misdirected entries.

    3.5 The Contest Sponsor reserves the right to cancel, terminate, modify or suspend the Contest, at its sole discretion, in the event a technical failure, computer virus or bug, unauthorized human intervention, tampering, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the Contest running as planned or the administration, security, fairness or normal operation of the Contest, subject, in Quebec, to the approval of the Régie des alcools, des courses et des jeux.

    3.6 If a selected entrant is awarded the Prize due to a system error, malfunction or defect, the Prize will be returned to the Contest Sponsor, to be re-awarded.

    3.7 Under no circumstances will the Contest Sponsor, its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies, be required to award more than one (1) Prize as indicated in these Rules and Regulations or award the Prize other than in accordance with these Rules and Regulations.

    3.8 No purchase is necessary. Members enrolling to become a Joint Petro Points Member require no expenditure or commitment to make an expenditure for such enrollment. To become a Joint Member, the Member can enroll by signing up on the Petro-Canada website or by calling the Petro-Canada call centre in Canada prior to or during the Contest Period.  Limit of one (1) entry per Member.

    3.9 Event Tickets which are accorded as prizes must be accepted as awarded, are subject to VANOC’s terms and conditions of use applicable to all ticketholders, and are subject to change without notice. For the avoidance of doubt, Event Tickets are not exchangeable for cash, may not be used in connection with any commercial promotion or contest and may not be sold for more than the face value of the ticket

    3.10 In the event that a person who has not reached the age of majority in his or her province of residence claims a Prize, an adult parent or legal guardian of that person, shall accept the Prize in his or her name and sign any required document to such effect.

    3.11 The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws.  By entering the Contest, the entrant agrees, subject to Rule 3.11, that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provisions of these Rules and Regulations or the running of the Contest.
