Petro-Points
The following terms and conditions apply to anyone who has been issued or has received a Petro-Points Card or a CIBC Petro-Points MasterCard Card:
| 1. |
The Petro-Points Program was developed as a loyalty program for drivers who visited Petro-Canada's retail sites and purchased gasoline and convenience store items. The applicant must have reached the provincial driving age to apply to the Program. Where a person under the driving age wishes to enrol in the Program, a parent or guardian must complete the application and consent to the terms and conditions. |

Petro-Points will be awarded on all purchases made at participating stations, with the exception of tobacco, Petro-Canada gift certificates, Petro-Canada Gift Cards, taxes on non-petroleum purchases, or any other items specified as exclusions from time to time.

By using the Petro-Points Card or a linked CIBC Petro-Points MasterCard Card, you acknowledge and agree to be bound by these terms and conditions and consent to the collection and use of personal information in accordance with Petro-Canada's privacy policy and statement. Petro-Points is for personal use only. Business corporations, joint ventures, partnerships, groups, or associations may not register. |

Petro-Points are not transferable from one account to another and may only be used for your own purchases. However, all enrolled Members in a household can accumulate Petro-Points together (through the use of supplementary cards) and will be considered as one account. Anyone holding a Petro-Points membership card within a household will be able to redeem Petro-Points on the account. |
| 5. |
All bonus Petro-Points will be awarded to the Petro-Points Member account. Bonus Petro-Points will not be awarded on any re-issue of lost, stolen or damaged cards. |
| 6. |
Petro-Canada will pay all applicable taxes on the rewards redeemed (except for taxes on flights or environmental taxes, or as otherwise advised by Petro-Canada). You may be required to pay additional fees such as, but not limited to, deposits, booking fees, fuel surcharges, excess baggage charges, auto installation fees, and other costs. |

Lottery tickets can be redeemed at a rate of 1,600 points per dollar. Available only at stations that sell lottery tickets. Age restrictions may apply for the purchase or redemption of lottery tickets using Petro-Points. Other restrictions may apply. Lottery tickets available in denominations up to $100. |
| 8. |
To redeem Petro-Points, you must have accumulated sufficient Petro-Points required for the item of your choice. |
| 9. |
When redeeming Petro-Points, your Petro-Points account will be reduced by the specified number of Petro-Points required for the reward being redeemed. If Petro-Canada deems it is reasonable to accept a return of the item, your account will be credited with the appropriate number of Petro-Points. Petro-Points rewards may not be returned for cash. |

Petro-Canada assumes no responsibility for any loss, damage, defect, injury, death or expense relating to any reward. |
| 11. |
Petro-Points have no cash value and cannot be exchanged for cash. Petro-Points cannot be sold or purchased and may not be exchanged, gifted, bartered, mortgaged or made subject to any security interest or charge. Notwithstanding the above, Petro-Canada may allow the exchange of Petro-Points from time to time with program partners, as defined in the Reward Guide. |
| 12. |
The rewards have the warranty of the manufacturer. |
| 13. |
Petro-Canada reserves the right to change or discontinue the Petro-Points program at any time, without advance notice. In the event of discontinuing the Petro-Points program, Petro-Canada will attempt to provide at least sixty (60) days notice to you, within which you may redeem any outstanding Petro-Points. |
| 14. |
Petro-Points cannot be used as credit against any outstanding CIBC Petro-Points MasterCard balance.

| 15. |
All Petro-Points totals, as shown on the purchase receipt, will be deemed to be correct, unless otherwise determined by Petro-Canada. Discrepancies must be addressed with Petro-Canada within sixty (60) days of the date the discrepancy occurred. |
| 16. |
Petro-Canada is not responsible for any errors or omissions with regard to the Petro-Points program. Petro-Canada is also not responsible for any lost or unauthorized use of Petro-Points or for any redemption of Petro-Points in the Petro-Points program. |
| 17. |
You must notify Petro-Canada (1 (800) 668-0220) immediately if you have lost or had your Petro-Points Card stolen. You must also notify Petro-Canada if your card is damaged. Petro-Canada is not responsible for any delays in replacing the Petro-Points Card, or for delayed or lost Petro-Points, while the Petro-Points Card is being replaced. |
| 18. |
Please also advise Petro-Canada (1 (800) 668-0220) of any changes in your address or account. |
| 19. |
Any failure to comply with any of these terms and conditions or any violation, fraud or abuse of the Petro-Points program may result in forfeiture of all points and possible termination of the Petro-Points Member's account without compensation as deemed appropriate and necessary by Petro-Canada. |
| 20. |
The Petro-Points program is void where prohibited by federal, provincial or local law. |
| 21. |
No more than 20,000 Petro-Points will be awarded on any single-purchase transaction made at any participating Petro-Canada Retail Station, unless otherwise agreed by Petro-Canada. |
| 22. |
Petro-Canada will not be liable or responsible in any manner for any tax consequences which may arise from any participation in the Petro-Points program. |
| 23. |
Petro-Points earned through Petro-Canada Partners will not be reflected in Member account balance until they have been transferred from the Partner. |
| 24. |
Petro-Canada assumes no responsibility for errors, omissions or delays in the reporting or transferring of Petro-Points earned with Petro-Canada's partners in the Petro-Points program. Partners determine the conditions under which they will issue Petro-Points, and those conditions may change at any time, without notice. |
| 25. |
Petro-Points will be forfeited upon the closure of a Petro-Points Member account. |
|
Petro-Canada reserves the right to close any Petro-Points Member account that has been inactive for twelve (12) consecutive months, and all accumulated Petro-Points will be forfeited. |

Monthly Points Top-Up on Fuel bonus Petro-Points Program
| During each calendar month, purchase between 150 and 249 litres of any grade fuel at participating Petro-Canada retail locations across Canada (excludes PetroPass, Wholesale and farm diesel) and receive 750 bonus Petro-Points. Or, during each calendar month, purchase 250 litres or more of any grade fuel at participating Petro-Canada retail locations across Canada (excludes PetroPass, Wholesale and farm diesel) and receive 1,000 bonus Petro-Points. |
| Points will be awarded during the first week of the following month based on all fuel purchases posted to the Petro-Points account in the prior calendar month. |
| Limit of 1,000 bonus points per household. |
| Members can access their Petro-Points account to monitor their progress towards their Monthly Points Top-Up on Fuel by registering for My Petro-Canada. |
| Only fuel sales at participating Petro-Canada retail locations processed through Petro-Canada’s Point-of-Sale system with a swipe of a valid Petro-Points card will be eligible for inclusion in the fuel volume used to determine the Monthly Points Top-Up on Fuel bonus Petro-Points awarded. |
|
Suncor Energy reserves the right to change or discontinue the Monthly Points Top-Up on Fuel at any time, without advance notice. |

Petro-Points, including the monthly 5,000 Petro-Points bonus, are earned on CIBC Petro-Points MasterCard purchases less returns. All Card purchases earn Petro-Points, except ineligible purchases at Petro-Canada (see note 3 for details). Cash advances, regular Convenience Cheques, balance transfers, fees, interest, payments and Petro-Points redemptions do not earn Petro-Points.
To earn the 5,000 Petro-Points bonus for a month, total CIBC Petro-Points MasterCard purchases (less returns) posted to that month's account statement must be more than $1,000. Petro-Points may not be credited if your MasterCard account is not in Good Standing or is overlimit; also, if your MasterCard account is not in Good Standing, previously credited Petro-Points may be removed from your Petro-Points account. Petro-Points, its partners, and Terms & Conditions are subject to change without notice.

The 50% more offer applies only to card purchases (less returns) at merchants classified by the MasterCard network as grocery stores or drug stores. Some merchants may sell these products/services, or are separate merchants who are located on the premises of these merchants, but are classified in another manner, in which case this added benefit would not apply. Any returns or other credits for card purchases at grocery or drug stores will be deducted from your Petro-Points Account at the rate of 15 Petro-Points for each dollar in returns/credits. Terms, conditions and eligible merchant categories may change without notice. |

When you use your CIBC Petro-Points MasterCard for an eligible purchase, you automatically earn 50% more Petro-Points based on the total base Petro-Points member's earned on a purchase.

| 1. |
In order to convert Petro-Points to Sears Club Points, each Petro-Points member must:
- possess a Sears Credit Card and be a Sears Club™ member
- phone the Petro-Canada Customer Service number 1 (800) 668-0220, or exchange

In order to convert Sears Club Points to Petro-Points, each Sears Club member must:
- be enrolled in the Petro-Points Program
- be assigned a Petro-Points account number
- phone Sears at 1 (800) 265-3675

| 3. |
If the Petro-Points membership number or Sears Card account number that is to be credited is invalid, the member's points will be returned to their original membership number or account number. |
| 4. |
1,000 Sears Club Points = 12,000 Petro-Points and vice versa. |
| 5. |
Petro-Points members and Sears Club members must convert a minimum of one thousand (1,000) Sears Club Points or twelve thousand (12,000) Petro-Points each time a conversion is requested. Each such conversion must be in multiples of twelve thousand (12,000) Petro-Points or one thousand (1,000) Sears Club Points. |

Petro-Points that are converted to Sears Club Points will be credited to that Petro-Points member's Sears account number. Sears Club Points that are converted to Petro-Points will be credited to that Sears Club member's Petro-Points account number. |
| 7. |
Converted points credited to either the member's Petro-Points account or Sears Card account will be processed within 72 hours. |
| 8. |
After June 1, 2012, the Sears Card can no longer be used to pay for purchases at Petro-Canada. The points exchange program is not being affected at this time. You can continue to exchange points between the two programs. |

Petro-Points, in its sole discretion, reserves the right to change the terms and conditions of this offer. Petro-Points may restrict, suspend, otherwise alter or terminate the Petro-Points/Sears Club exchange program without notice to Petro-Points members. Any changes will be posted on this website.

Auto Club
Effective Sept. 24, 2012, the Petro-Points Auto Club membership reward is no longer available. If you are a current member of the Petro-Points Auto Club, your membership will not be affected. If you have a Petro-Points Auto Club membership and would like further information, please call customer service at 1 (877) 378-3273.

Your Satisfaction is Guaranteed If for any reason, you are not completely satisfied with your Petro-Points Auto Club Membership, you are entitled to a full refund of your Membership fees (minus the cost of any services already provided) within the first 30 days of your Membership year. To receive a refund, you must apply in writing and return your Membership card. |
Membership Agreement:
|
| 1. |
For the purposes of this Contract, "Member" shall mean a person who is the owner registered on the Membership application. |
| 2. |
Benefits are authorized when the Member has paid fully, has fulfilled the 72 hour waiting period, and has registered his/her vehicle as a Member in good standing of the Petro-Points Auto Club. |
| 3. |
All benefits are based on mechanical breakdown and are as outlined or described in this Contract as vehicle based, and thus nontransferable. |
| 4. |
Benefits shall apply solely to matters arising while, and shall be in force only so long as, the Membership is in effect and in good standing at the time of the mechanical breakdown incident The number of service calls / membership year will be limited to a maximum of four (4) per member vehicle. |
| 5. |
Payment of fees is for professional legal counsel fees only and does not include payment for the costs of investigation, witness fees, court costs, judgments, fines, penalties, damages or costs awarded against the Member or any liability assumed by the Member. |
| 6. |
Benefits, as described in this Contract, are not provided:
- For alcohol and/or drug related charges (for legal services) nor when alcohol and/or drugs are a contributing factor to any other charges. The Member must also be in possession of a valid Driver's licence;
- While a Vehicle is not covered by Public Liability or Property Damage Insurance or has been immobilized by local licensing laws;
- If charges attributed to a motoring accident occurred while the Member was committing, or attempting to commit, a criminal offense that is not specifically covered by this Contract;
- For willful violation of the Highway Traffic Act;
- When service is covered by Public Liability Insurance

| 7. |
Legal Defense is applicable to Highway Traffic Act violations and is not provided when such a defense is already covered by insurance. Member coverage for legal services beyond those covered by insurance are limited to the member covered vehicle only and up to the benefit limitations stated in the "Legal Benefits" section of this agreement. |
| 8. |
If, during the Membership year, the Member changes his or her address, Petro-Points Auto Club must be notified immediately. |
| 9. |
All service operators providing service to Petro-Points Auto Club Members are independent contractors and are not employees of the Petro-Points Auto Club. Therefore, the Petro-Points Auto Club cannot and does not assume any liability or responsibility for any loss or damage to the Member's Vehicle or personal property resulting from the rendering of such service. Any loss or damage is the sole responsibility of the servicing facility and should be reported to the proprietor of the facility and the Member's own insurance company within 24-hours, prior to any repairs being carried out. |
| 10. |
Only one (1) service call can be authorized in a twenty-four (24) hour period. |
| 11. |
Any and all benefits not covered as outlined by this Contract are the responsibility of the Member. |
| 12. |
For the protection of all Members, the Petro-Points Auto Club may limit or suspend any benefits to any Membership if, at the discretion of the Petro-Points Auto Club, the Member is viewed as abusive. |
| 13. |
Petro-Points Auto Club will not provide service for:
- unattended and/or unlicensed Vehicles; (on an exception basis Petro-Points Auto Club will dispatch services to unattended vehicles where the member requests such service and agrees to accept any and all liability arising while servicing the unattended covered vehicle).
- areas that are not regularly travelled (i.e., vacant lot, open field, beach, private or impassable road, mud trail, construction site or to vehicles that are snowbound).
- taxis, limousines, commercial Vehicles and/or Vehicles declared a Recreational Vehicle of the A, B or C classes or any private vehicles that cannot be safely serviced with conventional automobile servicing equipment.

| 14. |
The Member shall be solely responsible for the cost of parts and/or labour to the Member's Vehicle. |
| 15. |
Loaded or altered Vehicles or trailers of any type may not be covered. Member may be asked to unload Vehicle before service is rendered. |
| 16. |
All Memberships are subject to acceptance by Petro-Points Auto Club. |
| 17. |
Petro-Points Auto Club reserves the right to amend and/or change benefits and/or fees without notice.

Limitation of Liability and Service |
|
|
The services being provided under the Petro-Points Auto Club Membership do not include or extend to:
- Transporting disabled Member Vehicle operators and their passengers to or from their disabled Vehicle or transporting such persons after the Service has been rendered.
- Accepting appointments for Service calls.
- Costs of parts, labour or incidental expenses (telephone calls, ferries and tools etc.) related to repair or servicing of the Member Vehicle under any circumstances.
- A Member Vehicle which is left unattended, unlicensed, unplated or immobilized by licensing laws, or to be towed to a salvage yard.
- Any charges relating to impounding and storage.
- Service to a Member Vehicle driven into an area not regularly travelled or which is impassable (e.g. private recreational roads, mud driveways, laneways or beaches). Members at Cottages or Farms on roads regularly travelled may be eligible for to Claim Reimbursement Service only as outlined in Schedule "C".
- Any damages resulting from the acts of the service provider are the sole responsibility of the Tower and should be reported to the Petro-Points Auto Club within 24 hours and prior to
any repairs.
- Charges for Services, repairs or labour which exceed those specified as benefits are at the Member's expense, at prevailing retail rates.
- Petro-Points Auto Club is available only to standard passenger vehicles serviceable by conventional auto servicing equipment.
- Any insurance-claim-applicable service relating to the member covered vehicle.
- Any fees associated with providing service on toll roads or highways.
- Member vehicles requiring service on service restricted or exclusive access highways must obtain service from the local authorized service facility and follow the Alternate Service Provider procedure under this program.
Note: It is the Member's responsibility to keep their Vehicle in roadworthy condition. |
Process for Using Petro-Points Auto Club Roadside Assistance Services |
| 1. |
The driver of a registered vehicle must contact Petro-Points Auto Club by calling the Call Centre directly from anywhere in Canada or the continental U.S. using the toll-free 1-877 emergency number. Service is available to serve Members 24 hours a day, seven days a week, 365 days a year, and is completely bilingual English/French during these hours. |
| 2. |
To obtain Service, the driver of a registered vehicle must provide the Petro-Points Auto Club customer care representative with their name, Petro-Points Auto Club membership number, the nature of the difficulty, specific vehicle description and their location. |
| 3. |
Petro-Points Auto Club will validate that the vehicle is associated with a valid Membership in the Program. |
| 4. |
If the vehicle is eligible for Services, a Petro-Points Auto Club service provider will be dispatched to assist the driver. |
| 5. |
If the vehicle is not eligible for Services, due to Membership expiry or due to having exceeded the annual Claim limit, a service provider will be dispatched, with services being provided at prevailing retail rates, provided the Member has an acceptable method of payment, which will not include the Petro-Canada Personal Credit Card. The member will be notified before dispatch that they are ineligible for services and that they will be charged at the prevailing retail rates. |

Alternate Service Provider Policy for Services Rendered by a Non Petro-Points Affiliated Service Provider
In the unlikely event that Petro-Points Auto Club is unable to provide service in the member's breakdown area, Petro-Points Auto Club will provide the member with a pre-authorized claim number, and the Member is to follow these steps for Reimbursement: |
| 1. |
When a driver of a registered vehicle has been pre-authorized to obtain his/her own service, they can call the nearest service facility. |
| 2. |
The driver of the registered vehicle must have the service facility provide a detailed receipt indicating the service required and clearly describing the vehicle that received the service. (Claims under mechanical breakdown towing must be accompanied by a detailed repair bill.) |
| 3. |
The Member must include on the receipt their Petro-Points Auto Club Pre-authorization #, his/her full name, address and Membership card number and ensure that the information is printed clearly. The receipt must be mailed to Petro-Points Auto Club at PO Box 24100 Pinebush Postal Station Cambridge, ON N1R 8E6 within thirty (30) days. (The Member should keep a copy of all the receipts for their records.) |
| 4. |
Upon receipt and confirmation of this information, Petro-Points Auto Club will send a reimbursement cheque for the amount owing to the Member up to the prescribed $50 limit. |
| 5. |
If the vehicle is not eligible for Services, due to Membership expiry or due to having exceeded the annual Claim limit, a service provider will be dispatched, with services being provided at prevailing retail rates, provided the Member has an acceptable method of payment, which will not include the Petro-Canada Personal Credit Card. The member will be notified before dispatch that they are ineligible for services and that they will be charged at the prevailing retail rates. |
Where the Petro-Points Auto Club does not respond within one (1) hour (or 90 minutes during daily rush hours)
During normal weather conditions, where the Petro-Points Auto Club does not respond within one (1) hour (or 90 minutes during daily rush hours), of a call from a driver of a registered vehicle, the Member is to follow these steps for reimbursement: |

The Petro-Points Auto Club shall advise the driver of a registered vehicle to call an alternative tower or service facility and provide the member with a pre-service authorization number and follow steps one to four above for reimbursement. |

2,000 bonus Petro-Points will be added to Member accounts within 2 weeks of joining AskingCanadians. Limit of 2,000 points per household.
Other than providing a Member with Petro-Points should they choose to become a panelist, Suncor has no ownership or involvement in the AskingCanadians Online Panel. If a Member decides to become a panelist, please read the AskingCanadians terms and conditions. |

Drinks and Snacks Reward
|
The following terms and conditions apply to the Drinks and Snacks Reward:
|
| 1. May only be used towards the purchase of drinks and snacks. |
| 2. Cannot be used for the purchase of any other product, including alcohol, tobacco and motor fuels. Also, not available for milk products in certain provinces. |
| 3. Reward has no cash value and cannot be used as cash back. |
| 4. Petro-Points redeemed may be for the full purchase price, or act as a partial discount towards the amount owing. |
| 5. Petro-Points redeemed may be greater than the purchase price rounded up to the nearest dollar; however, no cash back will be given. |
